Terms of Use

The terms that apply when you use this website or send us a question through it.

Effective date: October 1, 2026

These Terms of Use (“Terms”) are an agreement between you and Mariventus Technology (“Mariventus,” “we,” “us” or “our”) and govern your use of this website and any page that links to these Terms (the “Site”). By accessing or using the Site you agree to these Terms and to our Privacy Policy. If you are using the Site on behalf of an organization, you agree to these Terms on its behalf and represent that you have authority to do so. You must be at least 18 years old to use the Site. If you do not agree, please do not use the Site.

1. Informational purpose only

The content on the Site, including articles, published answers, service descriptions and examples, is provided for general informational purposes. It is not tailored to your environment and is not a substitute for advice from a professional who has reviewed your specific circumstances. You are responsible for any decision you make based on it.

2. The Second Opinion and other written answers

When you submit a question through the Site, we aim to send you a written answer, usually within five business days. We provide this at no charge and at our discretion. We may decline to answer any question, and response times are a goal, not a commitment.

A written answer:

  • is based only on the information you provided, which we have not verified;
  • is general guidance, and is not an assessment, audit, review, penetration test, attestation or opinion on the design or operating effectiveness of any control;
  • does not create a client, consulting, fiduciary or other professional relationship between you and Mariventus; and
  • is provided “as is” under Section 9 below.

A professional services relationship with Mariventus begins only when both parties sign a Master Services Agreement and a Statement of Work. Those agreements, and not these Terms, govern any services we perform for you.

3. Compliance frameworks, including HIPAA and SOC 2

We help clients prepare for and maintain compliance with frameworks including SOC 2, HIPAA, ISO 27001 and PCI DSS. So that there is no misunderstanding about what that means:

  • We are not a CPA firm and do not issue SOC 2 reports. SOC 2 examinations are performed under AICPA attestation standards by independent licensed CPA firms. We help organizations get ready for that examination and support them through it.
  • No one certifies HIPAA compliance. The U.S. Department of Health and Human Services does not certify or endorse any organization, product or consultant as HIPAA compliant, and neither do we. Each covered entity and business associate remains responsible for its own compliance.
  • We do not provide legal advice. Nothing on the Site, and no written answer, is legal advice or a legal opinion about your obligations under HIPAA, state privacy law, contract or any other law. Consult qualified legal counsel for that.
  • No outcome is guaranteed. Passing an audit or examination depends on your auditor, your controls and your evidence, which are outside our control.

4. What you may and may not submit

You may only submit information you have the right to share. You must not submit through the Site, or in reply to an email you receive from it:

  • protected health information as defined under HIPAA, or any other individually identifiable health information;
  • passwords, access keys, API tokens, private keys, connection strings or other credentials;
  • payment card data, bank account numbers or government identifiers;
  • personal information about other people, beyond a business contact name where needed; or
  • information you are prohibited from disclosing by law or by contract, including a third party’s confidential information.

Submitting information through the Site does not make Mariventus your business associate under HIPAA and does not create any obligation of confidentiality beyond what is described in our Privacy Policy. If you want to share confidential information, ask us for a nondisclosure agreement first. If you need us to handle PHI, a Business Associate Agreement must be signed before any PHI is shared.

You grant Mariventus a non-exclusive, royalty-free license to use and reproduce what you submit for the purpose of responding to you and, with your permission and after removing anything that identifies you or your organization, publishing questions and answers as described in our Privacy Policy. We do not use what you submit to train machine learning models.

5. Acceptable use

You agree not to:

  • use the Site in violation of any law or regulation;
  • probe, scan or test the vulnerability of the Site, or attempt to bypass any security or access control, without our prior written permission;
  • interfere with the Site’s operation, including by introducing malware or placing an unreasonable load on it;
  • submit spam, automated submissions or content that is false, misleading, defamatory, harassing or infringing;
  • scrape, harvest or systematically extract content or data from the Site, including for training artificial intelligence models, except through standard search engine indexing; or
  • impersonate any person or organization, or misrepresent your affiliation with one.

If you believe you have found a security vulnerability in the Site, please report it to webcampaign@mariventustechnology.com and give us a reasonable opportunity to fix it before disclosing it to anyone else.

6. Intellectual property

The Site and its content, including text, graphics, logos, design and code, are owned by Mariventus or its licensors and are protected by copyright, trademark and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view and print pages of the Site for your own internal business reference. You may quote brief excerpts with attribution and a link back to the Site. Any other use, including republication, modification or commercial distribution, requires our prior written consent.

“Mariventus” and the Mariventus logo are trademarks of Mariventus Technology. Microsoft, Azure and Microsoft 365 are trademarks of the Microsoft group of companies. Amazon Web Services and AWS are trademarks of Amazon.com, Inc. or its affiliates. SOC 2 is a service mark of the American Institute of Certified Public Accountants. All other trademarks belong to their respective owners. Their use on the Site is descriptive only and does not imply any endorsement, sponsorship or partnership unless we expressly say so.

7. Client references and results

Case studies, testimonials, savings figures and other results described on the Site reflect specific past engagements. They are not a promise or prediction of the results you will achieve, which depend on your environment and circumstances. Client names and details may be withheld or changed to protect confidentiality.

8. Third-party sites and services

The Site may link to third-party websites and services. We do not control them and are not responsible for their content, security or privacy practices. Your use of them is at your own risk and subject to their terms.

9. Disclaimer of warranties

To the fullest extent permitted by law, the Site, its content and any written answer are provided “as is” and “as available,” without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We do not warrant that the Site will be uninterrupted, secure or error-free, or that its content is complete or current.

10. Limitation of liability

To the fullest extent permitted by law, Mariventus and its owners, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to the Site, its content or any written answer, even if advised of the possibility of such damages. Our total liability for all claims arising out of or relating to the Site will not exceed one hundred U.S. dollars (US $100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to defend, indemnify and hold harmless Mariventus and its owners, employees, contractors and agents from any claim, loss, liability or expense, including reasonable attorneys’ fees, arising out of your breach of these Terms, your misuse of the Site, or information you submit in violation of Section 4.

12. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state courts located in Manatee County, Florida, or the United States District Court for the Middle District of Florida, and you consent to the personal jurisdiction of those courts. Either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

13. Relationship to other agreements

If you have signed a Master Services Agreement, Statement of Work, nondisclosure agreement or Business Associate Agreement with Mariventus, that agreement governs the services and information it covers and prevails over these Terms in the event of any conflict.

14. Changes and termination

We may modify these Terms at any time by posting the revised version on the Site with a new effective date. Changes apply to use of the Site after they are posted and do not apply retroactively to disputes that arose before them. We may suspend or restrict access to the Site, or any part of it, at any time. Sections 3, 4, 6, 9, 10, 11, 12, 13 and 15 survive any termination of your use of the Site.

15. General

These Terms, together with our Privacy Policy, are the entire agreement between you and Mariventus regarding the Site. If any provision is held unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent, and we may assign them in connection with a merger, acquisition or sale of our business. Section headings are for convenience only.

16. Contact

Questions about these Terms can be sent to webcampaign@mariventustechnology.com, or by post to Mariventus Technology, 3932 Santa Caterina Blvd, Lakewood Ranch, FL 34211, United States.
